Do you need permits to build a farm pond?

In most cases, you will probably need permits to build a farm pond. In some cases, you may need more than one. You’ll need to check federal, state and local planning bodies to see what kind of permits will be required. The U.S. Army Corps of Engineers has to approve plans for any recreational pond—though if there is at least one valid agricultural use, you may be eligible for an exemption. However, you will still need to file for the exemption through the Corps. The USDA must also issue a permit for your pond through the Natural Resources Conservation Service branch. If you will be using a federally protected waterway like a river or even a small stream, you will need a permit to use the water.

State and local regulatory agencies may also require you to get a permit. Check with your state’s Department of Environmental Protection, the Natural Resources department, or the environmental planning agency to see what permits may be required. At the local level, look to zoning boards and code enforcement offices to see if you will need a permit. Even rural areas with few building codes or zoning restrictions may have land use policies in place that require permits to build a pond.
